O R D E R

The petitioner is the defacto complainant. He wants the final report to be filed.

2.When the matter was taken up for hearing, the learned Government Advocate (Crl. Side) submitted that a negative final report was filed as early as on 25.09.2018. The petitioner was also served on the same day. A copy of the acknowledgement has also been shown before this Court. However, the jurisdictional Magistrate is yet to take a call in the matter. The jurisdictional Magistrate is directed to take a call in the matter on merits and in accordance with law within a period of three weeks thereafter. If the trial Magistrate decides to accept the final report, then RCS notice shall be served afresh on the petitioner so that the petitioner can file a protest petition. On such filing, the same will be disposed of on merits and in accordance with law within a period of four weeks thereafter.
