Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to register the petitioner's property in Survey No.T.S.No.2236/A, to an extent of 1014 sq.ft of land, situated at Ward No.16, Thandupalayam Gounder Street, Periyakulam, Theni District, based on the judgment and decree passed by the learned Principal District Judge, Madurai in A.S No.149 of 1997 dated 26.10.1998 and considering the petitioner's representation dated 08.03.2022.

O R D E R

This Writ Petition has been filed for issuance of a Writ of Mandamus, directing the respondents to register the petitioner's property in Survey No.T.S.No.2236/A, to an extent of 1014 sq.ft. of land situated at Ward No.16, Thandupalayam Gounder Street, Periyakulam, Theni District, based on the judgment and decree passed by the learned Principal District Judge, Madurai in A.S.No.149 of 1997, dated 26.10.1998 and considering the petitioner's representation dated 08.03.2022.

2. The case of the petitioner is that she is the owner of the land in Survey No.T.S.No.2236/A to an extent of 1014 sq.ft., situated at Ward No.16, Thandupalayam Gounder Street, Periyakulam, Theni District. In the year 1992, one Amirtham Ammal filed a suit https://www.mhc.tn.gov.in/judis 1/2

W.P(MD)No.23081 of 2022 against the petitioner and one Kannan in O.S.No.221 of 1992 before the Sub Court, Periyakulam. The said suit is decreed on 03.07.1996. Against which, the petitioner has preferred an appeal in A.S.No.149 of 1997 before the Principal District Judge, Madurai and the same was allowed on 26.10.1998. Thereafter, the petitioner has approached the second respondent for registration of the above mentioned property. But the second respondent has not considered the same. Hence, the petitioner has sent a representation dated 08.03.2022, to the respondents. Since the respondents have not considered the same, the petitioner has approached this Court.

3. The learned counsel appearing for the petitioner would submit that the petitioner is aged about 76 years and she wants to sell the property to third party. Hence, she has filed the present writ petition seeking direction to the respondents to register the property in S.No.T.S/No.2236/A to an extent of 1014 sq.ft.

4. The petitioner has to get the revenue records mutated in her name, on the basis of the decree and judgment passed in A.S.No.149 of 1997, dated 26.10.1998. After getting necessary documents viz., Patta, Chitta and after identifying the competent purchaser to execute a sale deed then to approach the Registrar for registration. Granting such liberty, this Writ Petition is disposed of. No costs.
