ORDER
The petitioner has approached this Court by filing the present Writ Petition seeking issuance of a Writ of Mandamus, to forbear the respondents 1 and 2 from constructing a bus stop in front of the petitioner's residential plot, bearing Door No.35 in Survey No.415, situated at Hanumandhampatty, Theni Taluk, Theni District, and to consider the petitioner's representation dated 31.07.2025.
2. It is submitted by the petitioner that, earlier, the bus stop was located on the same road, approximately 100 to 120 feet away from the petitioner's property. However, the respondents are now proposing to construct a bus stop immediately in front of the petitioner's residence, thereby, affecting the frontage and diminishing the utility and advantage associated with the property.

The learned Standing Counsel for the first respondent submits that the bus stop has been relocated to the present site pursuant to a compromise arrived at between the first and third respondents and one A.Arockia Samy before the Lok Adalat in P.L.A./B/No.2/2024, in the presence of the Senior District Judge (FAC), Theni. The learned counsel places reliance on the directions issued in the order of the Lok Adalat dated 27.09.2024, and contends that the ongoing construction is in compliance with the said order.

Upon considering the submissions made by the learned counsel for the petitioner and the learned Standing Counsel for the first respondent, this Court is of the view that the petitioner's grievance warrants due consideration. Admittedly, the petitioner was not a party to the proceedings in P.L.A./B/No.2/2024, which culminated in the order dated 27.09.2024 before the Lok Adalat.

The first respondent is therefore directed to explore the possibility of shifting the proposed bus stop to an alternative location, in such a manner that it does not obstruct or affect the petitioner's private property or any other private property abutting the said road. This exercise shall be completed by the first
respondent expeditiously and in any event, within a period of four (4) weeks from the date of receipt of a copy of this order.
6. The Writ Petition stands disposed of accordingly. No costs. Consequently, connected Miscellaneous Petition is closed.
