O R D E R
The present Writ Petition has been filed by the establishment covered under the Employment Provident Fund Act, challenging the order passed by the Appellate Tribunal directing the establishment to deposit 20% of the assessed amount as an interim order.
2. According to the learned counsel appearing for the establishment, the petitioner Management is facing financial crisis and in such circumstances, the interim order of the appellate Tribunal may be modified to 10% instead of 20% of assessed amount.
3. However, the learned Standing Counsel appearing for the respondent Employees Provident Fund Organization submitted that already the Tribunal having exercised its jurisdiction, has granted a concession to the petitioner Management for depositing only 20% assessed amount. In such circumstances, further concession may not be extended. 2/4
4. Considering the fact that 20% of the assessed amount would come around Rs.13,00,000/- (Rupees Thirteen Lakhs only), this Court is inclined to modify the impugned order and direct the petitioner Management to deposit a sum of Rs.8,00,000/- (Rupees Eight Lakhs only). The said amount shall be deposited on or before 03.09.2025.
5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petitions are closed.
