(R5 is Suo Motu Impleaded Vide Court Order Dated 30.09.2022 in Wp(MD)no.23116/2022) ... Respondents PRAYER :-Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, directing the respondent to grant medical reimbursement to the petitioner for his treatment undergone for Covid 19 critical care as per the recommendation dated 15.04.2021 of the 4th respondent within the time stipulated by this Court.

ORDER

The petitioner, who is a retired employee, is the beneficiary under the NHIS. He had affected due to COVID-19 and as such, he took treatment by incurring a sum of Rs.4,16,379/-. When the petitioner approached the respondents for medical reimbursement, the same has not been considered. Hence, the petitioner is before this court.

2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.

3. When the matter was taken up for hearing, the learned Government Advocate, submitted that 2nd respondent has forwarded the claim of the petitioner to the 4th respondent and hence, the petitioner's case would be considered.

4. In view of the said submission, this writ petition is disposed of with a direction to the petitioner to furnish the required documents to the 4th respondent and on receipt of the same, the 4th respondent shall consider the reimbursement of the petitioner. The said exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order. No costs.
