Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the 1st respondent to grant the separate patta in connection with the Survey Number.414/1A situated at Servaikaranpatti, Velvarkottai Revenue Village, Vedasandur Taluk, Dindigul District based on the representation along with the online application, dated 09.03.2024.

ORDER

Since his online application made on 09.03.2024 for grant of separate patta in respect of the property comprised in Survey No.414/1A situated at Servaikaranpatti, Velvarkottai Revenue Village, Vedasandur Taluk, Dindigul District had not been considered, the petitioner has approached this Court for issuance of mandamus to the 1st respondent to grant his patta as requested.

2. It is the case of the petitioner that she had purchased 60 cents of land in the above said survey number in the year 1969. Out of 60 cents in Survey No.414/1, she had sold 56 cents in the year 2002 to one Akkammal and Subbulakshmi and the remaining 4 cents which is now comprised in Survey No.414/1A remains in the petitioner's possession. The petitioner came to know that his patta bearing Patta No.2952 stands as a joint patta along with the 2nd respondent who is in no way connected to the property. Therefore, he had submitted an online application on 30.12.2023 for surveying and fixing the four boundaries. The Surveyor

had surveyed the property. However, boundary stones were not planted. The Surveyor had directed the petitioner to pay necessary fees for getting a separate patta. On 09.03.2024 the same was submitted by the petitioner. However, till date, the petitioner has not been granted with separate patta. Therefore, this writ petition.

3. Considering the request of the petitioner and taking note of the fact that the online application remains unattended from 09.03.2024, a mandamus is issued to the 1st respondent to consider the representation of the petitioner, dated 09.03.2024 and pass orders within a period of four

(4) weeks from the date of receipt of copy of this order.

4. With the above directions, this Writ Petition stands allowed. No costs.
