ORDER : The Court made the following order :- The petitioner / Accused No.5, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Section 454, 457 and 380 of IPC in Crime No.451 of 2022 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant locked his doors and went away on 24.12.2022 at about 10.30 a.m., and returned back to home on 25.12.2022 at about 05.00 p.m. At that time, he found the doors of his house, broken. 15 sovereigns of gold jewels were also stolen. Apart from that other household things were also missing. On that basis a complaint was preferred and a case was registered.
3. Learned counsel for the petitioner would submit that the petitioner is no way connected to the present occurrence. Since two other cases are pending, against the petitioner, the present case has been foisted against the petitioner, only based on the confession statement of the co-accused.
4. Learned Government Advocate (Crl.) would submit that earlier petition of the petitioner seeking anticipatory bail was dismissed by this Court by considering the nature of offences.
5. In view of the above submission, by considering the nature of the offences 2/3
and by considering the antecedents of the petitioner, involved in similar offences, this Court is not inclined to grant relief to the petitioner.
