For Respondent : Mr.R.Meenakshi Sundaram, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.611 of 2021 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused No.1 who apprehends arrest at the hands of the respondent police for the offence punishable under sections 147, 148, 448, 294(b), 427, 324, 365, 307 of IPC, in Crime No.611 of 2021 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that On 29.10.2021, the petitioners and the other accused kidnapped the defacto complainant's daughter. The first accused attacked the defacto complainant with aruval and other attacked her with wooden log and caused injuries to her. Hence, this complaint. 1/3
3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. Hence, he seeks anticipatory bail to the petitioner.
4.The learned Additional Public Prosecutor would submit that the injured was treated as inpatient and also discharged from the hospital on 02.11.2021 and investigation is pending. 5.Considering the facts and circumstances of the case and also considering the fact that the injured was discharged from the hospital, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.
6.Accordingly, the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Pattukottai, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C scrupulously.
