ORDER
(Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) Challenge has been made to the impugned order by which the petitioner's husband is transferred from Central Prison, Madurai to the Central Prison, Trichy.
2.The learned counsel appearing for the petitioner submitted that the convict prisoner and the petitioner are permanent residence of Nadupatti Village in Usilampatti Taluk, Theni District, whereas on administrative grounds, the prisoners, who are the native of Dindigul, were transferred to Central Prison, Trichy and thereby, the convict prisoner has falsely transferred to Central Prison, Trichy.
3.The fourth respondent has filed counter affidavit. 4.The learned Additional Public Prosecutor appearing for the respondents submitted that the Director General of Prisons and Correctional Services, Chennai, has issued an order No.TNPCS/3512/PW2, dated 09.05.2025 that in order to reduce the over crowding in Central Prison, Madurai, had asked the Superintendant of Central Prison, Madurai to transfer the convict prisoner as per the list of Central prison, Trichy. Pursuant to the same, the convict prisoners who are the native of Dindigul District have been transferred and before transfer, willingness was also obtained from the convict prisoner. 5.Having gone through the impugned order, we find the reasons for transferring the convict prisoners, who are the native of Dindigul, were transferred
to Central Prison Trichy. Admittedly, the petitioner and the convict prisoner are the native of Nadupatti Village, Usilampatti Taluk, Madurai District. Therefore, the impugned order passed by the fourth respondent dated 21.07.2025 in No. 1247873/ThaKu4/2025 stands set aside and the respondents are directed to retransfer the convict prisoner to the Central Prison, Madurai, within a period of one week from the date of receipt of a copy of this order. 6.With the above observation and direction, this Writ Petition stands disposed of. No costs.
