PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the 1st respondent to execute the Bailable Warrant pending against the 2nd Respondent in C.C.No. 31 of 2018 on the file of the learned Judicial Magistrate, Kodaikanal, Dindigul District For Petitioner : Mr.S.Jenifer Evangelin Veronica For Respondents : Mr.K.Suyambulinga Bharathi No.1 Government Advocate(Crl.Side)

ORDER

This petition has been filed seeking direction to direct the 1st respondent to execute the bailable warrant pending against the 2nd respondent in C.C.No. 31 of 2018 on the file of the learned Judicial Magistrate, Kodaikanal, Dindigul District

2. The petitioner initiated proceedings against the second respondent under Section 138 of the Negotiable Instruments Act in C.C.No. 31 of 2018 on the file of the learned Judicial Magistrate, Kodaikanal, Dindigul District. The second respondent did not appear before the trial court and as such the trial court issued warrant against the second respondent and the same was duly communicated to the first respondent. Thereafter the first respondent did not execute the same as against the second respondent.

3. Considering all these facts, the first respondent is directed to execute the bailable warrant issued by the learned Judicial Magistrate, Kodaikanal in C.C. No.31 of 2018 within a period of eight weeks from the date of receipt of a copy of this order.
