PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 4, more particularly, the third respondent to consider the petitioner's complaint dated 22.08.2023 as against the fifth respondent and his henchmen for the commission of illegal act of stealing, motor pump, motor parts, copper cable and allied material. This Writ Petition is filed seeking for a direction to the respondents Police to dispose of the representation dated 22.08.2023 of the petitioner.

According to the learned counsel appearing for the petitioner, the petitioner is a watchman of Beach Minerals (Sands) Company which was closed in the year 2015, as per the directions of this Court in Public Interest Litigation. It is submitted that the President of the Village has committed the theft of electric motors, pumps, copper cable and allied 2/5

materials, on which, the petitioner has given a complaint to the Police but no action is taken. Therefore, suitable directions are sought for.

3. The learned Government Advocate (criminal side) appearing for the official respondents submits that the complaint of the petitioner dated 22.08.2023 is registered as C.S.R.No.406 of 2023 and the enquiry is being initiated into and within a short time, they will complete the enquiry.

4. Considering the submissions made by the learned counsel appearing for the petitioner as well as the learned Government Advocate (criminal side) appearing for the official respondents, this Writ Petition is disposed of directing the respondents Police to complete the enquiry in the representation dated 22.08.2023 given by the petitioner which is registered as C.S.R.No.406 of 2023 as quickly as possible not later than two weeks from the date of receipt of a copy of this order. In case if the petitioner feels any threat in the hands of the President against whom he has made a complaint, he is at liberty to approach the respondents Police to file a complaint, on which, the respondents Police are directed to give 3/5

appropriate protection to him.

5. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
