Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the Respondents to transfer the patta to petitioner's name instead of petitioner's father name for the properties situated in the Survey numbers mentioned in the representation situated at Appanoor village, A.Poonavasal village, K.Veppankulam village and S.Tharaikudi village in Kadaladi taluk. Ramanathapuram District in the light of the petitioner's last representation dated 10.08.2022 within a stipulated time fixed by this Court. ORDER

The petitioner herein seeks a direction to the respondents 1 to 4 to transfer the patta in his name that stood in the name of the petitioner's father for the property mentioned in his representation, situated at Appanoor Village, A.Poonavasal Village, K.Veppankulam Village, and S.Tharaikudi Village in Kadaladi Taluk, Ramanathapuram District by considering his representation dated 10.08.2022. 2/5

2. It is the case of the petitioner that various items of the properties described in his representation were originally owned by his father, A.K.Mohammed Ali. He gifted those properties in favour of the petitioner under oral Hiba. Based on the oral Hiba, the petitioner sought the transfer of patta in his favour by submitting a representation dated 10.08.2022. The said representation has not been considered by the official respondents. Hence, the petitioner has come before this Court seeking necessary direction.

The learned Additional Government Pleader, who appeared for the official respondents, would submit that after the death of the petitioner's father, A.K.Mohammed Ali, the patta was transferred in the name of all the legal heirs of A.K.Mohammed Ali, including the name of the petitioner, by the proceedings of the fourth respondent dated 23.09.2021.

In view of the submission made by the learned Additional Government Pleader that the patta was transferred in the name of all the legal heirs of the deceased A.K.Mohammed Ali, including the petitioner, if aggrieved, it is for the petitioner to challenge the order passed by the fourth respondent mutating the revenue records in the name of all the legal heirs on 23.09.2021 by filing an appeal before the second respondent. 3/5
