Mr.S.Ravi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.91/2023 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/A6, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147,148,450,353,307 and 506(ii) of IPC in Crime No.91 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.The learned counsel for the petitioner would contend that the respondent police has foisted a false case against him and he has not committed any offence as alleged by the prosecution. He would further submit that the injured has been discharged from the hospital, hence he seeks anticipatory bail.

3. The learned Additional Public Prosecutor would submit that though the injured has been discharged from the hospital but the petitioner herein only instigated the other accused to commit the offence and it is a case of retaliation attack. He would further submit that three previous cases are pending against the petitioner, hence he objected to grant anticipatory bail to the petitioner

4. Heard both side and perused the materials available on record.

5. Considering the rival submissions on either side and considering the serious nature of offence and also considering the previous cases pending against the petitioner and also considering the stage of investigation, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.

6. Hence the petition stands dismissed.
