ORDER : The Court made the following order :- The petitioners/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 303(2) of the Bharatiya Nyaya Sanhita (BNS), 2023 and Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.983 of 2024, seek anticipatory bail. 2.Heard both sides.

3.The allegation is serious in nature. As far as the second petitioner is concerned, it is represented by the learned Government Advocate (Crl.Side) that the second petitioner is not an accused in this case and the same is recorded 4.As far as the first petitioner is concerned, the allegation is serious in nature. In spite of the ban on quarrying river sand, all the accused joined together and tried to quarry sand from Kollidam River by using JCB belonging to the first petitioner. Therefore, this Court is not inclined to grant anticipatory bail to the first petitioner. 2/3
