PRAYER :- For Bail in Crime No.772 of 2021 on the file of the respondent Police ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 04.10.2021 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C) of Narcotic Drugs and Psychotropic Substances Act, 1985, in Crime No.772 of 2021, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that on 14.10.2021, on receipt of secret information, the respondent Police have made a vehicle check up at Ramanathapuram Mandabam Highway Road at Pattanamkathan, Vallabai Nagar, ECR Road at about 06.45 pm, one four wheeler Hundai Car bearing Registration No.TN 04 P 6118, was intercepted and on the vehicle check up, the respondent Police had seized 23 kgs of Ganja
from the accused persons and on that basis, FIR came to be registered in Crime No.772 of 2021.
3.The petitioner's case is that she has not committed any offence as alleged by the prosecution, that she has noway connected with the alleged occurrence, that the respondent Police without any materials has falsely implicated the petitioner in the above case and that the petitioner has no knowledge about the other accused persons.
4.In pursuance of the directions of this Court, the learned Additional District Judge/Presiding Officer, Special Court for EC & NDPS Act Cases, Pudukkottai, has submitted a report, dated 27.10.2022, narrating the stage of the case and further stated that the reason for the delay was due to the delay caused by the prosecution in producing the witnesses.
5.When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the respondent, on instructions, would submit that the respondent undertakes to produce all the witnesses and complete the trial within one month. 6.Recording the submission made by the learned Additional Public Prosecutor, the learned trial Judge is directed to complete the trial and dispose of the case within a period of one month from the date of receipt of copy of this order.
7.With the above direction, this Criminal Original Petition is disposed of.
