O R D E R

Heard Mr.M.Rajendarn, learned Counsel appearing for the Petitioner and Mr.S.Shanmugavel, learned Additional Government Pleader for the respondents.

2.This Writ Petition has been filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the 1st and 2nd respondents to restrain the third respondent not to lay road in the petitioner's patta land bearing No.532, S.Nos.274/6 and 8 based on his representations, dated 27.08.2024 and 16.07.2025 within a stipulated time that may be fixed by this Court.

3.Mr.M.Rajendran, learned Counsel appearing for the petitioner, submits that the petitioner has submitted representations dated 27.08.2024 and 16.07.2025 in respect of his grievances and claim before the respondents. The copy of the representations, dated 27.08.2024 and 16.07.2025 given to the respondents are found at Page Nos.22 and 28 of 2/6

the paper book. He further prays this Court that a positive direction may be given to the 2nd Respondent to decide the representations of the Petitioner dated 27.08.2024 and 16.07.2025 on merits and in accordance with law.

4.Mr.S.Shanmugavel, learned Counsel for the Respondents submits that he has no objection to the prayer made by the learned Counsel for the Petitioner. He further submits that since the Petitioner has submitted representations on 27.08.2024 and 16.07.2025 to the Respondents, this Court may issue a positive direction to the 2nd Respondent to consider and decide the representations dated 27.08.2024 and 16.07.2025 on merits and in accordance with law within a specified time frame fixed by this Court.

5.After hearing the submissions made by the learned Counsel for the parties and without going into merits of the case, this Court directs the 2nd Respondent to decide the Petitioner's representations dated 27.08.2024 and 16.07.2025 and pass a reasoned and speaking order on merits, in accordance with law, within a period of four weeks from the 3/6

date of receipt of a certified copy of this order. The Petitioner is directed to serve a certified copy of this order along with the representations dated 27.08.2024 and 16.07.2025 on the 2nd Respondent. The 2nd Respondent shall communicate the decision taken by him to the Petitioner through Registered Post with Acknowledgement Due (RPAD) within a period of two weeks from the date of passing the order/decision. 6.With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
