O R D E R

The Writ Petition is filed seeking a direction to the first respondent for cancellation of patta issued in the name of Petitioner.

2.Mr.A.Baskaran, learned Additional Government Pleader takes notice for the respondents 1 and 2. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.It is the case of the Petitioner that he purchased the subject property in S.No.244/3 situated at Veppalodai Villae, Ottapidaram Taluk, Thoothukudi Districtunder registered sale deed in the year 1974. While so, the third respondent, who is none other than the elder brother of the Petitioner, filed an appeal before the first respondent seeking cancellation of patta issued in the name of Petitioner in respect of the subject property. The first respondent has issued an enquiry notice on 22.7.2025 in Na.Ka.Aa.No.Aa2/6148/20025 fixing the date of enquiry as 6.8.2025.The appeal filed by the third respondent has not been disposed of so far. Hence the Petitioner is before this Court with the present Writ Petition for the relief stated supra. 2/5

4.Mr.A.Baskaran, learned Additional Government Pleader who takes notice for the respondents 1 and 2, would submit that the first respondent has only issued an enquiry notice to the Petitioner fixing the date of enquiry on 6.8.2025. He would further submit that the appeal pending on the file of the first respondent will be disposed of on its own merits, within the time stipulated by this Court.

5.In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to dispose of the appeal pending on his file in Na.Ka.NO. Aa2/6148/20025, dated 22.7.2025 and pass final orders on its own merits after issuing notice to the Petitioner, third respondent and other interested parties, if any, within a period of 12 weeks from the date of a copy of this order.

6.With the above directions, the Writ Petition stands disposed of. No costs.
