Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing the respondents to refix the pay of the petitioner on par with her juniors promoted to the post of Tahsildar based on Tahsildar panel for the year 2009 with all consequential benefits and disburse the arrears by the considering the petitioner's representation dated 25.11.2024, within the time stipulated by this Court.

ORDER

The instant writ petition has been filed seeking for a direction to the respondents to re-fix the pay of the petitioner on par with her juniors promoted to the post of Tahsildar, based on Tahsildar panel for the year 2009 with all consequential benefits and disburse the arrears by the considering the petitioner's representation dated 25.11.2024, within the time stipulated by this Court.

2. By consent of both parties, this writ petition is disposed at the stage of admission itself.

The petitioner was appointed as Typist in the Revenue Department in the year 1984 and she has been periodically promoted to subsequent promotional posts and she was finally promoted as Deputy Tahsildar for the year 2006. Due to pendency of the charge memo and the criminal case against the petitioner, her name has been deferred from the list of promotional panel for the post of Tahsildar for the year 2009 -2010.

The learned counsel appearing for the petitioner submits that the disciplinary proceedings against the petitioner was dropped on 30.12.2011 itself and the petitioner was also acquitted from the criminal case in the year 2017 and the first respondent, vide order dated 20.08.2018 ordered for inclusion of her name in the list of promotional panel for the post of Tahsildar for the year 2009-10 and accordingly, the second respondent published revised panel list and she was subsequently promoted to the post of Tahsildar and she attained superannuation on 30.04.2019. However, pay has not been refixed on par with her juniors and hence, the present writ petition came to be filed.

5. The learned Special Government Pleader appearing for the respondents submits that the second respondent intends to send a proposal to the first respondent recommending to fix pay scale on par with her juniors and to grant consequential pensionary benefits.

6. Considering the facts and circumstances of this case and also the submission made by the learned Special Government Pleader, there shall be a direction to the second respondent to send a proposal to the 3/6

first respondent as aforesaid, within a period of two weeks from the date of receipt of a copy of this order and on receipt of the same, the first respondent shall pass appropriate orders on merits and in accordance with law, within a period of eight weeks thereafter.

7. With the above directions, this writ petition is disposed of. There shall be no order to costs.
