[Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] This Habeas Corpus Petition has been filed seeking a direction to the respondents 1 to 4 to produce the person or body of the detenue by name Soniya, W/o. N.Pradeeshkumar, D/o.P.Chandran, aged 32 years from respondents 5 to 8 before this Court and set her at liberty. Page No.2 of 6
2. The case of the petitioner is that the missing person Viz., Soniya is known to him and she was living five house away from his house in the same street and they belong to the same community and that there was a love affair between them. The respondents 5 and 6, who are the parents of the missing person objected to their love and they have started to seek bridegroom for the missing person. The missing person had informed the petitioner that if he does not marry her she would commit suicide. Without any other option, the petitioner had taken the missing person to the temple and got married on 15.06.2025 by exchanging garland and tying of Thali. Thereafter, the petitioner and missing person went to Thirupur and stayed in the petitioner's relatives house. In such circumstances, the missing person viz.
, Soniya was taken to illegal detention by her parents viz., the respondents 5 and 6. Despite the complaint given by the petitioner, no effective steps have been taken by the respondent Police to secure the missing person. Hence, the petitioner has come up with the present Habeas Corpus Petition.
3. Pursuant to the same, the respondent Police have produced the missing person, viz., Soniya, before us.
4. We enquired her, and she submitted that the petitioner is known to her, Page No.3 of 6
that they are from the same village and belong to the same community, and that there was a love affair between them. She further submitted that they got married on 15.06.2025 in a temple by exchanging garlands and tying the thali. She also stated that under the guise of arranging her marriage, her parents took her to their house and subsequently refused to allow her to leave. Now, she expressed her willingness to go along with the petitioner, husband.
5. Recording the same, the Habeas Corpus Petition stands closed. The respondent Police are directed to provide appropriate protection to the petitioner and the missing person, if required by them.
