Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent herein to consider the petitioner's representation dated 24.02.2025 and pass appropriate orders by granting no objection in furtherance of the proceedings of the second respondent in Na.Ka.No.1145/2025/A3 dated 19.05.2025 with respect to the land comprised in survey Nos. 257/1B, 257/3A, 257/5B in patta No.871 in javadhupatti Village, Oddanchatram Taluk, Dindigul District within a time stipulated by this Court.

ORDER

Mr.S.S.Madhavan, learned Additional Government Pleader takes notice for the respondents.

2. This writ petition is disposed of at the time of admission, without expressing any opinion on the merits of the claim of the petitioner pursuant to the purchase of the subject land vide registered sale deed dated 16.06.2003.

3. It appears that the petitioner is now seeking a No Objection Certificate and is proposing to sell the land.

4. The learned counsel for the petitioner has placed reliance on the recommendation of the second respondent dated 19.05.2025 bearing Na.Ka.No.1145/2025/A3, in connection with the request of the petitioner addressed to the first respondent.

5. The learned counsel for the petitioner has also placed reliance on the fixation of fair rent by the Settlement Tahsildar vide proceedings dated 25.05.1973, issued under Section 8(2)(91)(b) of the Tamil Nadu Minor Inams (Abolition and Conversion into Ryotwari) Act, 1963. 2/4

6. Prima facie, it appears that the sale of the temple land may not be impermissible. Be that as it may, the first respondent shall consider the recommendation of the second respondent and pass appropriate orders on merits and in accordance with law, within a period of six months from the date of receipt of a copy of this order.
