Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents 1 to 5 to take action against the respondents 6 to 8 for the illegal excommunication of the petitioner and her family members from celebrating along with village people and relatives in the Kumbabisegam of "Arulmighu Malvai Karuppu" temple, Pidampatti Village situated at Singithakurichi Village, Kulathoor Taluk, Pudukkottai District scheduled on 15.09.2024 by considering the representation dated 03.09.2024 in a time bound manner.

ORDER

This writ petition has been filed seeking orders to direct the respondents 1 to 5 to take action against the respondents 6 to 8 for the illegal excommunication of the petitioner and her family members from celebrating along with village people and relatives in the Kumbabisegam 2/6

of "Arulmighu Malvai Karuppu" temple, Pidampatti Village situated at Singithakurichi Village, Kulathoor Taluk, Pudukkottai District scheduled on 15.09.2024 by considering the representation dated 03.09.2024 in a time bound manner.

2.Mr.M.Muthumanikkam, learned Government Advocate(Civil Side) takes notice for the respondents 1, 3 & 4 and Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondents 2 & 5. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3.The learned counsel appearing for the petitioner would submit that since the petitioner's family had participated in the inter-caste marriage, the private respondents herein have refused to receive temple tax and also refused to permit them to participate in the Kumbabisegam of "Arulmighu Malvai Karuppu" temple, Pidampatti Village situated at Singithakurichi Village, Kulathoor Taluk, Pudukkottai District, which is scheduled to be held on 15.09.2024.

4.The learned Government Advocate(Civil Side) would submit that there are 150 families in the village, out of which 10 families, including the petitioner's family are on one side and the remaining families are on the other side.

5.Considering the nature of charges levelled, the third respondent is directed to convene a peace committee meeting by giving notice to the petitioner, private respondents and other interested parties, conduct enquiry and take a decision, within a period of three days from today (10.09.2024).

6.With the above direction, the Writ Petition stands disposed of. No costs.
