This writ petition has been filed for issuance of a writ of Mandamus, directing the respondents to sanction the loan amount of Rs.10,00,000/- eligible amount from employees contribution from my E.P.F. account within a time frame.
2. Heard Mr.K.Thirugnana Sambandan, learned counsel for the petitioner and Mr.Raja, learned Standing Counsel, who accepts notice on behalf of the respondents.
3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
4. The petitioner was appointed as a Driver in the respondent Corporation on 25.01.1998. Due to financial debt, the petitioner's ancestral property was scheduled for sale by tender on 28.05.2025. To address this, the petitioner submitted an application on 03.09.2024, along with NRL Form 31, 2/6
requesting a loan from his employee's contribution in his EPF Account No. 10986. Additionally, on 25.04.2025, the petitioner submitted a representation to the respondents, reiterating his request for the loan. As no action was taken on this representation, the petitioner has filed the present Writ Petition before this Court.
5. Learned counsel for the petitioner would further submit that the petitioner would be satisfied if a direction is issued to the respondents to consider the representation of the petitioner dated 25.04.2025 and pass appropriate orders thereon, within a time frame to be fixed by this Court.
6. Considering the above facts and circumstances, without going into the merits of the case, this Writ Petition is disposed of with a direction to the respondents, to consider the representation of the petitioner dated 25.04.2025 and pass appropriate orders in accordance with law, after affording an opportunity of hearing to all the parties concerned. Such exercise shall be completed as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not 3/6
