Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to issue Passport to the petitioner by processing his application in File No.MD1065279102825 based on the explanation/representation dated 04.08.2025 within a time limit stipulated by this court and pass such other or further orders as this Court may deem fit and proper in the circumstances of this case.

ORDER

The petitioner is before this Court for a Mandamus to direct the first respondent to process the passport application dated 28.06.2025 of the petitioner, based on the explanation/representation, dated 04.08.2025.

The learned Government Advocate for the second respondent submits that the petitioner has been arrayed as Accused No.3 in an FIR registered against the petitioner and three others in Crime No.537 of 2024 dated 12.11.2024 for the offence under Section 12 of the Tamil Nadu Gaming and Police Laws Act 1930.

3. The learned Government Advocate for the second respondent confirms that a charge sheet has been prepared on 12.11.2024 and filed on 21.11.2025. He further confirms that the charge sheet has not been taken on file by the concerned Court namely Judicial Magistrate- VI, Madurai. 2/5

4. Considering the same, there can be no impediment in directing the first respondent to process the petitioner's passport application.

5. Accordingly, the first respondent is directed to process the passport application of the petitioner and issue passport to the petitioner as expeditiously as possible within a period of 6 weeks from the date of receipt of a copy of this order.

6. It is also made clear that in case charge sheet filed against the petitioner is taken on file, the petitioner shall voluntarily surrender the passport before the concerned court and retrieve the same as and when the petitioner proposes to travel abroad by filing appropriate application. If the petitioner fails to comply with this condition, the first respondent is at liberty to cancel the passport.
