Prayer in Crl.MP.(MD)No.12433 of 2023:- This Criminal Miscellaneous Petition filed under Section 482 of Criminal Procedure Code, pleased to relax the condition imposed by this Court against the petitioners herein in Crl.A(MD)No.579 of 2023 dated 27.07.2023 and thus render justice.
Prayer in CRL.A(MD)No.579 of 2023 :- This Criminal Appeal is filed (under SECTION 14-A(2) of the Schedule Caste and the Schedule Tribes(Prevention of Atrocities) Amendment Act,2015) to call for the records relating to the impugned order dated 14.07.2023 made in Crl.MP.No.1305 of 2023 on the file of the learned Special Court for Exclusive Trial of Cases under SC/ST Act,1989, Sivagangai and set aside the same by allowing the Criminal Appeal and consequently, enlarge the appellants on bail in connection wit Crime No.62 of 2023 on the file of the second respondent Police. ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. T.Veerakumar, Advocate for the Petitioner and Mr.M.Vaikkam Karunanidhi, Government Advocate for the respondents 1 & 2, this Court made the following order:
This Miscellaneous Petition has been filed to relax the condition imposed on the petitioners in Crl.A.(MD).No.579 of 2023 on 27.07.2023. 2.The learned counsel for the petitioners would submit that the petitioners have complied with the Conditions imposed by this Court regularly. 3.The learned Government Advocate (Criminal Side) would submit that though the first appellant is having one previous case, however, petitioners are
complying with the conditions imposed by this Court regularly. Further, the investigation is completed and the final report was filed on 22.08.2023 (NTF), before the learned Sessions Judge, Special Court for Exclusive Trial of Cases under SC/ST Act, Sivagangai.
4. Considering the said submission, the condition imposed as against the petitioners are relaxed and the petitioners are directed to report before the respondent police as and when required for interrogation.
