ORDER: The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for 1/4

the offences punishable under Section 302 of IPC, in Crime No. 1485 of 2016, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 01.08.2016, the defacto complainant alleged that the accused attacked the deceased with Aruval in head and shoulder. The deceased sustained multiple injuries. Hence, the apprehension of arrest. Hence, a case has been registered as against the petitioner. 3.The learned counsel appearing for the petitioner submitted that the petitioner was detained under Act 14, therefore, he could not appear as and when it was required by the Trial Court. The learned counsel appearing for the petitioner relied on the order passed by this Court in H.C.P.(MD)No.544 of 2024, dated 26.06.2024. Therefore, this Court is accepting the contention of the petitioner. 4.The learned Additional Public Prosecutor appearing for the respondent submitted that the offences committed by the petitioner are serious in nature and the petitioner is under non-bailable warrant.

5.Considering the facts and circumstances of the case, this Court is directing the 2/4

petitioner to surrender before the Trial Court wherein NBW is pending. The petitioner shall submit a NBW recall petition before the Trial Court. On such submission, the Trial Court shall consider the same in accordance to law on merits as early as possible. 6.With the above said directions, the criminal original petition is ordered as stated supra.
