Writ Petitions filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the entire record pertaining to the impugned order passed by the fourth respondent in Na.Ka. No.894/A1/2023 dated 07.08.2023 and quash the same as illegal and consequently direct the respondent to continue to disburse the same allowance without any reduction or recovery. Challenging the show cause notice dated 07.08.2023, issued by the fourth respondent, the petitioner has filed the present writ petition.

2. Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The petitioner is presently serving as a Teacher at P.U.M.S. Usilampatti Bazaar School, which falls under the jurisdiction of 2/6

the respondents No. 3 and 4. The grievance of the petitioner is that, based on the State Audit Report of the Education Department, the impugned order came to be passed against him, alleging that an excess amount of Rs.16,02,463/- had been paid to him. Aggrieved by the said order, the petitioner has filed the present writ petition.

4. On the other hand, the learned Additional Government Pleader appearing for the respondents submits that the impugned proceeding is only in the nature of a show cause notice. It is further submitted that if the petitioner submits his explanation before the competent authority, the same will be duly considered and appropriate orders will be passed in accordance with law.

5. In the light of the above submission, this Court directs the petitioner to submit her explanation, along with the grounds raised in this writ petition, within a period of fifteen days from the date of receipt of a copy of this order. Upon receipt of such explanation, the respondents shall consider the same and pass appropriate orders on merits and in accordance with law, within a period of two months thereafter. 3/6

6. With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
