respondent in Pani.2(5)/2691695/2022 dated 28.06.2022 quash the same, subsequently directing the respondents to regularize the period of suspension.

ORDER

The petitioner was working as a District Revenue Officer in Virudhunagar District. While he was in service he was issued with a charge memo and was also placed under suspension. Therefore, he has been retained in the service despite attaining the age of superannuation. Challenging the same this writ petition is filed. 2.This court entertained this writ petition on 29.08.2023 and ordered notice. When the matter was taken up for hearing on 12.12.2025 there was no representation for the petitioner. Therefore, the case was directed to be listed under the caption for dismissal. Even though the case is listed today under the caption for dismissal, there is no representation for the petitioner.

3.The respondents have filed a counter affidavit stating that the enquiry as against the petitioner is over and the enquiry officer has submitted his report to the disciplinary authority for necessary orders. The learned Additional Government Pleader has relied on the order passed by this Court in W(MD)No.16794 of 2023, dated 21.08.2023 and submitted that the similar writ petition filed by the co-delinquent one A.Paul Rathinaraj was dismissed by this court with a direction to the respondents therein to conclude the disciplinary proceeding within a period of two months.

4.The Government have issued a compendium of instructions vide GO.Ms.No.81 Human Resources Management (N) Department, dated 04.08.2022 by prescribing time limit for finalisation of disciplinary proceedings, within a period of 10 days from the filing of the enquiry report. Moreover, this court has also already issued a direction on 21.08.2023 to the respondents to complete the disciplinary proceeding within a period of two months, however, for the best reasons known to them, the disciplinary proceedings is not yet completed. 3/5

5.Considering the above, this writ petition is dismissed with a direction to the respondents to conclude the disciplinary proceedings and pass final orders within a period of six weeks from the date of receipt of a copy of this order. No costs. Consequently connected miscellaneous petition is closed.
