ORDER : The Court made the following order :- The respondent police registered a case as against this petitioner in Crime 1/5

No.78 of 2025 for the offence under Sections 296(b) & 103(1) BNS and remanded him into judicial custody on 18.06.2025. Therefore, the petitioner has filed this petition seeking bail.

2.The case of the prosecution is that the petitioner is the son-in-law of the deceased. There was a matrimonial dispute between the petitioner and his wife, due to which, she went to her mother house. When the petitioner attempted to take her back, there was a dispute arose between the parties, in which, the petitioner is said to have stabbed the deceased with knife. 3.The learned counsel for the petitioner submits that the occurrence was taken place in the mother-in-law's house and the complaint was lodged by the sister of the deceased, who is living in a separate place. Though the prosecution claims that the wife has deserted the petitioner and went to her parental house, she has not preferred any complaint and she has also not been added as witness. He further submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. However, he is languishing in jail from 18.06.2025.

4.The learned Government Advocate(Crl.side) appearing for the respondent opposes for grant of bail on the ground that the investigation is not yet completed. 5.Considering the period of incarceration and the relationship of the parties, this Court is inclined to grant bail to the petitioner with certain conditions. 6.Accordingly, this Criminal Original Petition is ordered and the petitioner is ordered to be released on bail, i) on the petitioner executing a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Uthamapalayam.

ii) The petitioner and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the government in proof of their residence address;

iii) The petitioner shall report before the respondent Police daily 3/5

two times, ie., morning at 10.30 am., and evening at 05.00 pm., for a period of thirty days.

iv) The petitioner shall not misuse the liberty granted to him by indulging in any further offence and shall not tamper with the prosecution witnesses. He shall be available for the trial as well. v) On violation of any of the above conditions by the petitioner, the respondent police shall move an application for cancellation of the bail.
