For Respondent : Mr.S.Ravi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.146 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406, 408, 379, 420, 467, 468, 471,120 (B) of IPC in Crime No.146 of 2023 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the petitioners herein created forged bill as if the entire materials were dispatched and handed over the parties concerned whish in turn caused huge loss to the defacto complainant, hence the case. 3.The learned counsel for the petitioners would contend that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. He would further submit that the petitioners have appeared before the respondent for enquiry and they also have co-operated with the enquiry, hence he seek anticipatory bail.

4. The learned Additional Public Prosecutor would submit that the accused person have committed misappropriation of materials to the tune of Rs.17 lakhs. He

would further submit that some of the accused are still absconding and the signatures in the indent have to be verified. Further investgation is still in the initial stage, hence he objected to grant anticipatory bail to the petitioners.

5. Heard both side and perused the materials available on record.

6. Considering the rival submissions on either side and considering the serious nature of offence and also considering the fact that the investigation is in preliminary stage and also considering the gravity of offence this Court is not inclined to grant anticipatory bail to the petitioner at this stage.

7. Hence the petition stands dismissed.
