ORDER : The Court made the following order :- The petitioner/A3, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No.210 of 2025, for the offence under Sections 296 (b), 118(1), 109(1) and 351(3) of BNS, has filed this petition seeking anticipatory bail.
2. The case of the prosecution is that on 19.06.2025 at 4.30 p.m., when the defacto complainant was coming near Mandhai of their village, A1 to A3 came there, abused the defacto complainant in filthy language, assaulted him with an aruval indiscriminately and caused injuries at his head and right hand. On gathering of public, A1 to A3 criminally intimidated the defacto complainant with dire consequences and fled the scene of occurrence. Hence, the case.
3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. However, this case has been foisted against the petitioner. He further submits that the accused Nos.1 and 2 were released on bail. Therefore, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) is not in a position to explain the overt act attributed to the petitioner and the nature of the injury sustained by the defacto complainant.
5. Since the learned Government Advocate (Crl. Side) is not equipped with this 2/4
case and considering the fact that the co-accused have already been enlarged on bail, this court is inclined to grant anticipatory bail to this petitioner.

Accordingly, this Criminal Original Petition is ordered and the petitioner is ordered to be released on bail in the event of arrest or on his appearance within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate on condition that (i) the petitioner executes a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties each for a like sum to the satisfaction of the Judicial Magistrate Court, Vadipatti. (ii) The petitioner and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the government in proof of their residence address;
(iii) The petitioner shall appear before the respondent police daily twice, i.e. morning at 10.30 a.m. and evening at 5.30 p.m. until further orders. He has to co-operate for the investigation. (iv) The petitioner shall not misuse the liberty granted to him by indulging in any further offence and shall not tamper with the prosecution witnesses.
(v) On violation of any of the above conditions by the petitioner, 3/4
the respondent police shall move an application for cancellation of the anticipatory bail.
