PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, calling for the records relating to the impugned notice in pending Doc.No.19/2024 dated 10.04.2024 and consequential impugned proceedings in impounding Document File No.1/2024 dated 28.06.2024 passed by the 2nd respondent, quash the same as illegal and consequently direct the respondents to register the rectification deed dated 13.03.2024, presented by the petitioner. 1/5

ORDER
The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned notice in pending Doc.No.19/2024 dated 10.04.2024 and consequential impugned proceedings in impounding Document File No.1/2024 dated 28.06.2024 passed by the 2nd respondent and consequently direct the respondents to register the rectification deed dated 13.03.2024, presented by the petitioner
2. The petitioner is the daughter of one Gopalan. The said Gopalan has already executed a settlement deed dated 25.07.2007 in the name of one Natarajan, who is the brother of the said Gopalan. However, while executing the said settlement deed, there is a mistake in mentioning the survey number in the original settlement deed i.e., S.No.231/1B2 was mentioned in the document. However, it has to be mentioned as S.No. 231/1A2. On perusing the same, it is seen that the extent of the property is one and the same ie., 33 cents and there is no discrepancy in other contents of the document. In such circumstances, the respondents cannot impose 2/5
stamp duty while registering the same. Further, the said original settlement deed was executed between the brothers. Now the executant of the settlement deed died. The legal heir of the executant is the petitioner herein who wants to execute the rectification deed as a legal heir of the said Gopalan. Therefore, there is no third party transaction in the present case. Hence, the respondents are bound to register the rectification deed without insisting of additional stamp duty. Therefore, the impugned order is quashed. The respondents are directed to register the document within a period of four weeks from the date of receipt of a copy of this order. 3.With the above directions, this Writ Petition stands allowed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
