Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st respondent to conduct enquiry and grant permit to continue use the public pathway based on petitioner representation dated 08.07.2023 within the time limit that may be stipulated by this Honble Court For Petitioner : Mr.M.Vivek For Respondent : Mrs.K.Malathi, AGP for R1 to 5 Mrs.S.Devasena for R7

ORDER

This writ petition has been filed to direct the 2nd respondent to consider petitioner's representation dated 08.07.2023. 2/6

2. The learned counsel for the petitioner would submit that in this case, the petitioner has given a representation dated 08.07.2023 requesting the 2nd respondent to conduct enquiry and grant permit to continue use the subject public pathway. However, the said representation was not at all considered by the respondent till date. Hence, this petition.

3. In reply, the learned Additional Government Pleader appearing for the respondent would submit that the petitioner's representation will be disposed of by the respondent within a period of 8 weeks.

4. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondent and also perused the entire materials available on record.

5. In view of the above, without expressing any opinion on the merits of the matter, this Court directs the respondents to consider the representation of the petitioner dated 08.07.2023 and conduct enquiry and thereafter pass appropriate order, on merits and in accordance with 3/6

law, within a period of 8 weeks from the date of receipt of a copy of this order.

6. With the above directions, this writ petition is disposed of. No cost.
