Prayer: This Criminal Original Petition filed under Section 482 Cr.P.C., to call for records relating to the FIR in Crime No.165 of 2020 on the file of the first respondent and quash the same as against the petitioner is concerned.

ORDER

This criminal original petition is filed to set aside the proceedings in Crime No.165 of 2020 on the file of the first respondent.

2.The case of the prosecution is that on 08.08.2020 at about 12.15 p.m after filling the petrol in his vehicle, the petitioner refused to give proper change. When it was questioned by the defacto complainant, he scolded him in filthy language and run away from the occurrence place. With the above allegations, the respondent police registered the FIR.

3.While pending this petition, this Court suggested the petitioner to get apology from the second respondent. Accordingly, the petitioner met the second respondent in person and submitted the written apology to the second respondent and the same was received on 06.12.2021 by the second respondent. The second respondent also accepted the apology tendered by the petitioner. 4.The learned Government Advocate(Crl.Side) would submit that the first respondent completed the investigation and filed a final report before the Judicial Magistrate, Valliyoor and the same was returned for certain defects.

Crl.O.P.(MD)No.19196 of 2021 for his conduct and he has also conveyed his sincere apology to the second respondent, I am of the view that no useful purpose will be served in keeping the FIR in Crime No.165 of 2020 pending on the file of the first respondent and also the continuation of the impugned proceedings may affect his future and career. Hence, this Criminal Original Petition is allowed and the entire proceedings in connection with Crime No.165 of 2020 on the file of the first respondent is quashed as against the petitioner is concerned.
