PRAYER :-Civil Revision Petition filed under Article 227 of the Constitution of India to set aside the fair and decreetal order passed in I.A.No.01 of 2024 in A.S.SR.No.1236 of 2024 dated 04.07.2025 on the file of Principal District and Sessions Judge, Kanyakumari filed by the 1st respondent herein.

ORDER
The Civil Revision Petition is filed against the fair and decreetal order passed in I.A.No.01 of 2024 in A.S.SR.No.1236 of 2024 dated 04.07.2025 on the file of Principal District and Sessions Judge, Kanyakumari filed by the 1st respondent herein.
2. Since no adverse orders are going to be passed against the respondent No.1, notice to the respondent No.1, is dispensed with.
3. The learned counsel for the petitioner would submit that the petitioner is the respondent in AS SR No.1236/2024, in which, the 1st respondent/plaintiff filed an application in IA No.1/2024 for condoning 2/5
the delay of 246 days in filing the appeal suit and the same was allowed. Challenging the same, the petitioner is before this Court. He would further submit that pending the Civil Revision Petition, the appeal suit itself is numbered and hence, he prays for early disposal of the same. 4.Considering the limited scope of the matter and taking into consideration the fact that the appeal suit itself is numbered in AS NO. 93/2025, no further orders are required to be passed in the petition. However, the trial Court is directed to dispose of AS No.93/2025 as expeditiously as possible, preferably, within a period of twelve months from the date of receipt of a copy of this order. 5.Accordingly, the Civil Revision Petition is disposed of. No costs. Consequently connected Miscellaneous Petition is closed. 22.08.2025 NCC : Yes/No Index : Yes/No RR 3/5
