O R D E R

The present Writ Petition has been filed by a Junior Assistant working in a Local Fund Audit Department, challenging G.O.(Ms) No.15 Finance (Local Fund) Department, dated 18.01.2018, wherein G.O.(Ms) No.12 Finance (Local Fund) Department, dated 07.01.2012 has been cancelled.

2. The grievance of the writ petitioner is that G.O.(Ms) No.12 Finance (Local Fund) Department, dated 07.01.2012 should be restored by quashing G.O.(Ms) No.15 Finance (Local Fund) Department, dated 18.01.2018.

It is brought to the notice of this Court that G.O.(Ms) No.12 Finance (Local Fund) Department, dated 07.01.2012 was challenged by the General Secretary, Tamil Nadu Local Fund Audit Department Inspectors' Association in W.P(MD) No.16501 of 2013. The writ petition came to be allowed on 20.02.2017. In compliance with the orders of this Court, G.O.(Ms) No.15 2/5

Finance (Local Fund) Department, dated 18.01.2018, has been issued cancelling G.O.(Ms)No.12 Finance (Local Fund) Department, dated 07.01.2012.

4. As a third party, the petitioner herein has filed W.A(MD) No.1318 of 2018, challenging the order passed in W.P(MD) No.16501 of 2013. This Writ Appeal was disposed of on 18.09.2024 on the ground that G.O.(Ms) No.12, dated 07.01.2012 has already been cancelled by way of G.O.(Ms)No.15, dated 18.01.2018.

5. The present position is that, as on today G.O.(Ms) No.12, dated 07.01.2012 is not in force. Writ Appeal filed by the appellant challenging the quashing of G.O.(Ms) No.12, dated 07.01.2012 has also been disposed of. In such circumstances, the petitioner cannot challenge G.O(Ms) No.15, dated 18.01.2018, which has been issued in compliance with the orders of this Court in W.P(MD) No.16501 of 2013. Therefore, nothing survives to be adjudicated in this writ petition.
