ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 296(b), 118(2), 351(3) of BNS, in Crime No.325 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 24.07.2025 at about 08.30 a.m., the petitioner along with other accused persons had trespassed into the defacto complainant's land and cutting the trees which was questioned by the defacto complainant for which the petitioner along with other accused persons had attacked the defacto complainant with Aruval and wooden log and caused injuries. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seek anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that the injured person is still in hospital and the investigation is still pending. Hence, he opposed for grant of anticipatory bail to the petitioner. 2/3

Considering the facts and circumstances of the case and also the nature of the offence committed by the petitioner, the injured person is still in hospital, the petitioner has committed serious offence and the investigation is still pending, if the petitioner is released on bail, he may tamper the witnesses and abscond and hence, this Court is not inclined to grant anticipatory bail to the petitioner.
