ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 8(c), r/w 20(b) (ii)(B) & Section 25 of Narcotic Drugs and Psychotropic Substances Act, in Crime No.835 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 1.100 Kgs of Ganja.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that based on the confession statement alone, the petitioner's name is implicated in this case. 4.The learned Additional Public Prosecutor appearing for the respondent police submitted that based on the confession statement of the co-accused the petitioner was arrayed as an accused in this case and the petitioner is the main accused and he has purchased the Ganja in bulk and distributed the same to other accused persons for selling.

CRL OP(MD). No.19174 of 2021 5.Considering the facts and circumstances of the case and the gravity of offence committed by this petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this criminal original petition is dismissed. sd/- 06/12/2021 / TRUE COPY / / /2022 Sub-Assistant Registrar (C.S.)
