This Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 103 days in filing the present restoration petition as against the order https://www.mhc.tn.gov.in/judis passed in Tr.CMP(MD)No.130 of 2024, which was dismissed for default on

26.04.2024.

2. When the matter is taken up for hearing today, the learned counsel for the petitioner would submit that the petitioner sought for transfer of H.M.O.P.No.594 of 2023 from the file of the Family Court, Theni to the Family Court, Thiruppur. In the meanwhile, the divorce petition in H.M.O.P.No.594 of 2023 itself was allowed and divorce was granted vide judgment, dated 04.10.2024 and that therefore, the above petition has become infructuous.

3.Recording the same, this Civil Miscellaneous Petition is dismissed as infructuous.
