ORDER

The petitioner is an accused person who has been accused for certain offences under the provisions of the Indian Penal Code and Information Tenchnology (Amendment) Act, 2008 INF C.

2. Learned counsel for the second respondent submits that the case is still under investigation and no charge sheet has been filed till date before the concerned Court.

3. Considering the same there can be no impediment in directing the respondent to process the passport application of the petitioner. However, it is made clear that as and when the charge sheet is filed before the concerned Court, petitioner shall surrender the passport before

the concerned Court. In case, if the petitioner failed to comply with the above direction, it is open to the second respondent to take steps to seize the passport and deliver to the concerned Court.

4. Writ Petition stands disposed with the above observation. No costs.
