ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) This Writ Petition has been instituted to direct the 3rd respondent to take necessary action upon the petitioner's representation dated 05.07.2025, which is pending before the 3rd respondent.

2.The learned counsel appearing for the respondents has submitted a copy of the proceedings of the District Collector, Kanniyakumari District at Nagercoil dated 02.08.2017. The rear side gate is adjoining to the office of the Chief Educational Officer, Nagercoil. That apart, the land has not been transferred to the District Judicial Administration. The learned District and Sessions Judge, Kanniyakumari made a request to the District Collector to open the gate adjacent to the Chief Educational Officer for the exclusive usage of the Hon'ble Judges, since the main gate is being used by the lawyers, litigants, staff and other persons, visiting the Court campus. Considering the request, the District Collector has 2/4

taken a decision that the pathway is the combined pathway for the office of the Chief Educational Office and the combined Court and there is no land transfer towards the District Collector and the pathway will not have any ownership by the District Court. It is also ordered to install a gate at the back side of the wall of the combined Court in order to have access to the pathway exclusively for Hon'ble Judges only.

3.In view of the above, this Court is of the considered view that it is a concession granted by the District Collector in consultation with the Chief Educational Officer. Thus, the petitioner cannot claim usage of the said pathway as a matter of right. Therefore, the District Judicial Administration cannot extend the said concession to the lawyers, litigants and general public. It is not in dispute that the lawyers, litigants and general public are having free access through main gate. Thus, this Writ Petition is devoid of merits and therefore, dismissed. No costs.
