ORDER
This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner, the learned Central Government Standing Counsel for the respondents 1 and 2 and the learned Government Advocate (Crl.Side) for the third respondent.
2. The petitioner has applied for a fresh passport in application No. MD1065280416525, dated 03.07.2025.
3. The learned counsel for the petitioner submits that the petitioner is the first accused in the case registered in Crime No.179/2024, dated 23.03.2024 for the offences under Sections 294(b), 323, 324, 506(2) of IPC and Section 4 of the 2/5
Tamil Nadu Prohibition of Harassment of Women Act, 2002 before the third respondent Police Station.
4. The learned Government Advocate (Crl.Side) for the third respondent confirms the same, however, submits that no charge sheet has been filed so far and no case has been taken on file by the Criminal Court.
5. Considering the same, there can be no impediment in processing the passport application of the petitioner. Therefore, there shall be a direction to the second respondent to process the passport application of the petitioner and issue the same as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order.

It is, however, made clear that in case, during the interregnum, a charge sheet is filed against the petitioner before the concerned Court, the petitioner shall surrender the passport before the concerned Court and retrieve the same from the said Court as and when the petitioner desires to travel abroad. 3/5
7. It is made clear that in case the petitioner fails to comply with any of the above stipulations, the respondents 1 and 2 are at liberty to seize the passport of the petitioner and to hand it over to the concerned Court or in the alternative, it is open for the respondents 1 and 2 to take steps to cancel the passport to be issued to the petitioner.
