This Petition is filed under Section 430(1) of BNSS praying to suspend the sentence imposed against the petitioner in Spl.S.C.No.148/2011 dated 30.07.2025 on the file of the learned Special Judge, Special Court for Vigilance and Anti-Corruption, Thiruchirappalli and enlarge him on bail pending disposal of the above appeal.
ORDER
The Criminal Miscellaneous Petition is filed to suspend the sentence imposed 1/4
by the learned Special Judge, Special Court for Vigilance and Anti-Corruption, Thiruchirappalli, dated 30.07.2025 in S.C.No.148/2011 till the disposal of appeal. 2.The petitioner is the sole accused, who has been found guilty for the offences punishable under Sections 7 and 13(2) r/w 13(1)(d) of Prevention of Corruption Act and convicted and sentenced to undergo 2 years imprisonment and fine of Rs.5,000/-, in default to undergo 3 months SI for the offence under Section 7 of Prevention of Corruption Act and to undergo 3 years imprisonment and fine of Rs.5,000/-, in default to undergo 3 months SI for the offence under Section 13(2) r/w 13(1)(d) of Prevention of Corruption Act.
3. The learned counsel appearing for the petitioner submitted that the very sanction itself has not been obtained and the Investigation Officer has stated in his evidence that the sanction order has not been given by the authority who has to give the sanction and not obtaining proper sanction would affect the root of the case of the prosecution.
4. The learned Additional Public Prosecutor submitted that the prayer for suspension of sentence can be considered on conditions.
5. As there is no possibility of taking up the appeal within a short period and also considering the grounds made out to admit this appeal, I feel it is appropriate to suspend the sentence alone on conditions. Accordingly, the substantive part of the 2/4
sentence alone is suspended and the petitioner is enlarged on bail on the following conditions:
i. that the petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Special Judge, Special Court for Vigilance and AntiCorruption, Thiruchirappalli; ii. that the petitioner shall appear before the said Court on all working days at 10.30 a.m. till the disposal of appeal.
