ORDER
The petitioner claims that the properties in S.No.60/4 to an extent of 43 cents and in S.No.60/2 to an extent of 2 acre 25 cents in Semmalapatti Revenue Village, Aalavayal, Ponnamaravathi Taluk, belong to him and he is in continuous possession. During the UDR Survey, these properties have been wrongly classified as "Anadeenam" and therefore, the petitioner has preferred an appeal before the first respondent / District Revenue Officer in Appeal No.D3/21183/2017 to correct the UDR entries. With a grievance that the appeal proceedings is still pending without any progress, he has filed this writ petition.
2.Learned Additional Government Pleader sought time to ascertain the reasons for the pendency of the appeal from the year 2017. 3.This Court considered the rival submissions made on either side. 4.The relief sought for in this writ petition is for a mandamus directing the first respondent to dispose of the appeal in 2/4
No.D3/21183/2017 within a time frame. Considering the limited scope of relief sought for and considering the fact that the appeal preferred by the petitioner is pending for more than five years, this writ petition is disposed of with a direction to the first respondent to conclude the appeal proceedings and dispose of the same, on merits and in accordance with law, after affording due opportunity of hearing to the parties concerned, within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
