For Respondent : Mr.R.Meenakshi Sundaram, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.374 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) r/w 20(b)(ii)(B) of NDPS Act, in Crime No.374 of 2021, seeks anticipatory bail.

2.Reading of the FIR shows that while the respondent police party was on patrol duty on 19.09.2021, they went to the place of occurrence and saw two persons were there. On seeing the police party, one person fled away from the occurrence spot and they enquired the another person, he disclosed that this petitioner was present at the place of occurrence and 1200grams of contraband was seized from him. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent and not committed any offence as alleged by the prosecution. He would further submit that in this case, there is no material to implicate the petitioner, other than the confession statement of the co-accused and because of his previous cases, this case was foisted against him.

CRL OP(MD). No.19287 of 2021 4.The learned Government Advocate (Crl.Side) appearing for the respondent would submit that the petitioner is having four previous cases at his credit.

5.Considering the gravity of offence and also the bad antecedents of the petitioner, this Court is not inclined to enlarge the petitioner on anticipatory bail.
