Respondents PRAYER :- Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned amended voters list of 2020 dated 14.02.2020 of 4th respondent municipality issued by 3rd respondent, quash the same and consequently direct the respondents herein to restore the names of 1/4

villagers living in Wards I, II, and III of the Vellakavi Village Panchayat, Kodaikanal Taluk, Dindigul in the voters list of the Vellakavi Village Panchayat and further direct the respondents herein to facilitate the government building premises vatta canal meant for eradication of poverty (VPDP) as election booth for the residents of Wards I, II and II of Vellakavi Village Panchayat without isolating them from the Vellakavi Village Panchayat.

ORDER

(Order of the Court was made by the Hon'ble the Chief Justice) When we expressed our preliminary view that prayer as sought cannot be granted, Shri K.Appadurai, learned counsel, sought leave to withdraw the petition with liberty to approach the first respondent/ second respondent with a representation seeking the relief as sought.

2. Shri K.Appadurai states that petitioner had sent a detailed representation to second respondent on 31st December 2020 and the same was forwarded to first respondent, who informed petitioner that Respondent No.3, District Election Officer/District Collector, Dindigul District, has been directed to look into the matter and initiate 2/4

appropriate action. Shri K.Appadurai, states that Respondent No.3 has done nothing thereafter and hence, he had to approach this Court by way of this writ petition.

3. Shri SR.A.Ramachandran, learned Additional Government Pleader states that he shall immediately inform Respondent No.3 to look into the representation and also forward a copy of the petition as well as the typed set before the end of this month, so that Respondent No.3 shall initiate action and complete the process within twelve weeks thereafter.
