ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 77(2) BNS in Crime No.426 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that while the defacto complainant was bathing in her house, the petitioner had video graphed the same in his mobile phone. Hence, the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution and that the petitioner is no way connected with the case, a false case has been lodged as against the petitioner. The petitioner is ready and willing to abide any conditions which may be imposed by this Hon'ble Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that the mobile phone of the petitioner is not yet recovered and that investigation is pending. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the nature and gravity of the offence allegedly committed by the petitioner and also taking note of the fact that investigation is at crucial stage 2/3

and also the facts that so far property has not been recovered and that if the petitioner is released on bail, he will tamper the evidence, this Court is not inclined to grant anticipatory bail to the petitioner.
