This Petition has been filed seeking orders to condone the delay of 39 days in filing the criminal appeal against the judgment of conviction and sentence in Spl.S.C.No.97 of 2024, dated 29.04.2025 on the file of the learned Sessions Judge, Special Court for Exclusive Trial of Cases under POCSO Act, Dindigul.

2.Despite receipt of Court notice, the defacto complainant has not turned up.

3.Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) appearing for the State and also perused the records.

4.Considering the quantum of delay and the reasons assigned, the delay of 39 days in filing the Criminal Appeal, is condoned and accordingly, this petition is allowed. Registry is directed to number the appeal, if it is otherwise in order and list the matter in the usual course.
