This petition has been filed to condone the delay of 123 days in filing the above Civil Miscellaneous Appeal against the judgment and decree passed in MCOP.No.1266 of 2023 on the file of the Motor Accident Claims Tribunal / The Special District Judge No.II, Trichirappalli, dated 28.01.2025.

2. Notice was already served on Respondent Nos.1, 3, 4 and 5 and their names have also been printed in the cause list. Notice was not served on respondent No.2. Therefore, this Court vide order dated 16.03.2026 directed the learned counsel for the petitioner to effect notice through paper publication. Accordingly, paper publication has been effected and proof of service has been filed and service is completed for Respondent No.2 also. However, there is no appearance either in person or through counsel.

3. Considering the reasons assigned in the affidavit filed in support of the petition, this petition is allowed and delay is condoned.
