PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to initiate the Revenue Recovery Proceedings against the third respondent to recover the award passed by the Joint Commissioner for Labour, Trichy in W.C.No.94 of 2015, dated 16.12.2021, on the basis of proceedings of the Joint Commissioner for Labour, Trichy dated 09.09.2024. O R D E R

The present Writ Petition has been filed by the beneficiary of the award passed by the Joint Commissioner of Labour, Trichirapalli, in W.C.No.94 of 2015, dated 16.12.2021 seeking a Mandamus as against the first respondent to recover the award amount.

2. The second respondent has filed counter affidavit dated 26.08.2025. Paragraph Nos. 7 and 8 of the counter affidavit is extracted as follows:

7. I humbly submit that, due to the insufficient 2/6

fund in the third respondent, for allocation of fund to the writ petitioner as per the order of the Tribunal, further progress of fund allotment, the 6th respondent forwarded the communication in Na.Ka.No.

2582/2025/A5, dated 12.08.2025 to the Director (Planning) District Urban Development Department, Thanjavur District with regard to the plea of the writ petitioner's compensation as per the order of the tribunal in W.C.No.94 of 2015 order dated 16.12.2021 and the same is pending for the further progress.

8. I humbly submit that, in the Mean time our Authorities made the communication to the Director (Planning) District Urban Development Department, Thanjavur District vide the Proceedings in Na.Ka.No.4046/2024/A3, dated 12.08.2025 for allocation of the Compensation to the Writ Petitioner's Son as per the order of the Joint Commissioner of Labour, Thiruchirapalli.

3. Considering the above said facts, it is clear that so far no appeal has been preferred as against the award of the Joint Commissioner of Labour, Tiruchirappalli.

4. In such circumstances, there shall be a direction to the respondents herein to disburse the award amount to the writ petitioner on or before 31.12.2025.

5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
