ORDER
The petitioner is the 7th accused in Crime No.123 of 2024 on the file of the respondent Police, which was registered for the offence under Sections 147, 294(b), 323, 324 and 506(2) IPC. He has moved this petition seeking to quash the FIR in Crime No.123 of 2024 registered against him.
2. Today, when this petition is taken up for hearing, the learned Government Advocate (Crl. Side) submits that the investigation in Crime No.123 of 2024 was completed and the final report has also been filed before the learned Judicial Magistrate, Shenkottai, through e-filing in LTN 20220002176 on 24.06.2024.
3. Since it is reported that the final report has been filed in Crime No. 123 of 2024, without ascertaining the materials relied on by the investigating agency in the final report, this Court is not inclined to proceed with the available FIR. Therefore, this Criminal Original Petition is dismissed with liberty to the petitioner to challenge the final report, if he is having any ground. Mere filing of the final report through e-filing is not 2/4
sufficient. The respondent Police shall ensure that the final report is taken on file within a reasonable time. It is not only the responsibility of the respondent Police, the trial Court is also expected to take the final report on file, without any delay. Consequently, connected miscellaneous petition is closed.
